Practice Areas — Elder Law
As we get older, many of us are faced with difficult and important decisions regarding our healthcare and our financial well-being. Mr. Adamski can help you plan for both the present and the future through the use of wills, trusts, powers of attorney, living wills, and health care directives.
Mr. Adamski has learned that we must all prepare for what may be the most challenging time in our lives, those later years when we lose our ability to vigorously do for ourselves and begin to depend on others. Almost no one is fully prepared for this time of life. Children or others are asked to step in and assist, usually after a crisis situation develops. Unfortunately, most people have little or no experience in coping with these unique situations.
Mr. Adamski assists elders and family members in coping with these difficult times.
Basic Advice:
Protect your assets and keep your peace of mind.
Homestead is the sacred cow in Florida . It cannot be attacked by creditors, during or after death, if handled properly. This is the most valuable asset most elders possess and should always be protected.
Nursing Home Care: Learn the Medicaid qualification rules before you need nursing home care and prepare yourself to qualify without wasting your assets.
Keep Control: Do not give your assets to others in order to avoid probate or administration after death. Very often the assets will not be returned if needed, even by trusted children. Elders need assets to live and maintain their self-respect.
Make a Will or Trust: Everyone needs a will or trust to pass his or her property on after death. A trust will also protect your assets if you become incompetent because the assets can only be used for your benefit. Do not simply give your money to another and trust them to use it for your benefit.
Make a Power of Attorney for your property: Give a Durable Power of Attorney to a TRUSTED PERSON ONLY. This is a very powerful document and should NEVER be given to anyone you do not trust. A power of attorney is void at death and your will or trust is used to distribute your property.
Name a Health Care Surrogate to make your health care decisions if you cannot make them for yourself.
Make a Living Will to allow a dignified passing.
